For each Dave Matthews Band concert listed in section 1(d) below, (i) one Entrant will be randomly drawn from all eligible entries to win 2 Front Row Tickets. The Approximate Retail Value for each concert is $65. This prize will be awarded for 32 concerts listed in Section 1(d) below. Winners of this Sweepstakes will be notified by Myspace message, e-mail, telephone, or U.S. Mail. Grand Prize. Each entrant in the sweepstakes above is also eligible to win the Grand Prize consisting of (i) roundtrip economy class airfare, accommodations, and 4 Front Row Tickets and 4 lounge passes total to attend Dave Matthews Band’s performances at The Hollywood Bowl, in Los Angeles California on Monday, October 1, 2007, and Tuesday, October 2, 2007. Approximate Retail Value $2,500. The winner will be notified by Myspace message, e-mail, telephone, or U.S. Mail. Certain Disqualifications. Return of any prize notification as undeliverable will result in disqualification and a random drawing for an alternate winner. To enter the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes an entrant should submit a legitimate entry at least 15 days in advance of each of the concerts listed in Section 1(d) above. There are two methods of entry. To register via Myspace, an entrant must provide the following required information: (a) a valid username registered with Myspace that has willingly been submitted by the account holder along with your name, e-mail address, and age verification, and (b) the desired concert date and location. Upon submitting a complete entry, an entrant will automatically be entered to win the pair of Concert Tickets to the desired concert and to enter the Grand Prize. Limit one entry per entrant. Chances of winning are dependent on number of eligible entries received. Miscellaneous. Any error or omission in the information on the entry form may void entry. Limit one entry per person with valid Myspace membership. By participating, all entrants agree to abide by these Official Rules. Eligibility. The two Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes are open to registered Myspace members who have the Dave Matthews Band listed in their Top Friends on their Myspace page, and persons who submit post card entries that are legal residents of the United States (other than residents of Rhode Island and Florida) and over the age of 18 years old as determined by Sponsor at the time of registration entry. Directors, officers and employees of Myspace, Inc. ("Myspace") and/or Bama Rags Recordings, LLC ("Sponsor") or any of their corporate affiliates, and their immediate families, are not eligible to enter or win. Each Winner assumes all liability for use of the prize. Sponsor reserves the right to refuse to award a prize to or on behalf of any minor if the consent of a parent or legal guardian is not given through such a release. Winner Selection and Notification. The odds of winning for each prize are dependent upon the total number of eligible entrants. All drawings will be conducted under the supervision of Sponsor. The decisions of Sponsor are final and binding in all matters relating to the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes. Entries are the property of Sponsor and will not be returned. Each winner will be notified in person, by phone, e-mail or United States mail. If a winner cannot be reached after a reasonable effort has been made or if an entrant is found to be ineligible, an alternate winner may be selected in Sponsor’s sole discretion. Winners of the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes will be randomly drawn from all eligible entrants. One winner of Concert Tickets will be drawn at least 14 days prior to each concert. One Grand Prize winner will be drawn from all entrants for all concerts on September 20, 2007. Multiple entries are not permitted. Each entrant for the Concert Tickets prize may only register to win tickets for a single show. If an individual attempts to submit more than one entry, such additional entries will be discarded and the entrant may be disqualified in Sponsor’s sole discretion. Entry Deadlines. Individual concerts. Entries for each concert must be received no later than fifteen (15) calendar days prior to the respective concert. Grand Prize. To be eligible for the Grand Prize, entries must be received no later than 11:59 PM Eastern Daylight Time on September 15, 2007. Taxes; Expenses. Any applicable taxes shall be the sole responsibility of the winner. Any expenses not specifically included in the prizes (including ground transportation to and from airports and accommodations, all meals, and all other expenses incurred in connection with any trip) described in these rules shall be the sole responsibility of the winner. General Conditions. The Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes shall be void where and to the extent prohibited by law and is subject to all applicable laws, including, without limitation, federal, state, and local laws and regulations. In the event of non-compliance by any winner with the official rules of the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes, an alternate winner may be selected by Sponsor. Prizes are non-transferable. Return of any prize or prize notification as undeliverable will result in a disqualification of the winner and an alternate winner may be selected. All prizes will be awarded. Releases. By participating, entrants agree that Myspace, Sponsor, those involved in the development, production (including prize suppliers), implementation and distribution of the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes, Musictoday, LLC and Dave Matthews Band, Inc., and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion (hereinafter collectively called "Released Parties"), shall not be liable for any claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes, including entry and participation in the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes, and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to such entrant’s participation in the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes, such entrant will indemnify and hold each of the Released Parties harmless from and against any and all such claims, including reasonable attorneys’ fees related thereto. Released Parties shall not be liable for entries that are delayed, lost, misdirected, mis-delivered, incorrect or incomplete, and such entries will be not be eligible for the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes, Released Parties shall not be responsible for any technical malfunctions of any telephone network, computer on-line system, computer equipment or software; program malfunctions or other failures; delayed computer transactions or network connections; any errors of any kind, whether human, mechanical or electronic; or any combination thereof, including, without limitation, any injury or damage to the computer of any entrant or any other person related to or resulting from downloading any part of the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes should viruses, bugs or other causes beyond their control corrupt the proper administration or security of the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes. Sponsor reserves the right to modify the rules of the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes in any way or at any time, as long as reasonable notice is given. All taxes on any prize won are the sole responsibility of each winner, including, without limitation, any federal, state, or local taxes which may be deemed applicable in such winner’s jurisdiction of residence. The Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes shall be governed by the laws of the Commonwealth of Virginia, United States of America. By participating in the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes, entrants agree that the state and federal courts located in the Commonwealth of Virginia shall have jurisdiction over any dispute or litigation arising from or relating to the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes and that venue for such litigation shall be only in the Circuit Court for the City of Richmond, Virginia or the United States District Court for the Eastern District of Virginia, Richmond Division. In the event of early termination, Sponsor may select winner from all eligible entries received at time of termination based on the criteria above. In the event of a dispute concerning the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the email account is registered. Any person attempting to defraud or in any way tamper with the Dave Matthews Band 2007: Bring a Friend to the Bowl Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law.
