By entering or participating in the Live Trax Volume 16 Pre-Order Warehouse Dave Matthews Band Cruise Giveaway Sweepstakes (the "Sweepstakes") you agree to all of the following rules:

How to Enter. No purchase is necessary to enter the Sweepstakes. All Musictoday customers 21 years of age and older (excluding California and Rhode Island residents) who Pre-Order Live Trax Volume 16: 06.26.2000 Riverbend Music Center, Cincinnati, OH through the Warehouse Live Trax Vol. 16 Pre-Order store will be automatically entered into the Sweepstakes.  You may also enter online by visiting the Sweepstakes at http://web.davematthewsband.com/cruise/contest/ at any time before 03:00 p.m. ET on September 11, 2009.  If you enter online, you will be asked to submit entry information online which will include your e-mail address, date of birth and other registration information as prompted.  In addition, anyone may enter the Sweepstakes by mailing a 3" x 5" postcard with sufficient postage containing the sweepstakes name, Live Trax Volume 16 Pre-Order Warehouse Dave Matthews Band Cruise Giveaway Sweepstakes, which must be exact, your name, home address, telephone number, e-mail address and date of birth (mm/dd/yyyy) to P.O. Box 1873 Charlottesville, VA 22903.  Any error or omission in the information on the card will void the entry.  Limit one entry per individual. Limit one entry per post card.  By participating, all entrants agree to abide by these Official Rules.

Eligibility. The Sweepstakes is open to legal residents of the United States (excluding California and Rhode Island) who are age 21 and over. Proof of age may be required. Winners will have to provide an affidavit certifying they are 21 or older and the Sponsor may require winners to produce photo ID as proof of age.  Employees of Musictoday, LLC (“Sponsor”) and its affiliates, employees of Red Light Management, or Bama Rags LLC, employees of any prize sponsor and its affiliates, and members of such employees' immediate families (their parents, spouses, siblings (natural born or adopted), children (natural born or adopted)) or households are ineligible to participate in the Sweepstakes.  If the Sponsor, in its sole discretion, determines that any entry is ineligible, it may void the entry.

Prize Deadlines. All entries for the Sweepstakes must be received by September 11, 2009 at 3:00 p.m. ET. Ten winners will be selected from random daily drawings which will begin Friday August 28, 2009 and occur every business day through Friday, September 11, 2009 (excluding Labor Day holiday on September 7, 2009).

Winner Selection and Notification. The odds of winning are dependent upon the number of eligible entries received.  All drawings will be conducted under the supervision of Sponsor on or about September 12, 2009 in Charlottesville, Virginia. The decisions of Sponsor are final and binding in all matters relating to this Sweepstakes. Entries are the property of Sponsor and will not be returned. Entrants need not be present at the drawing to win a prize. The Winner will be notified by phone, e-mail or United States mail. If a winner cannot be reached after a reasonable effort has been made within five (5) business days of Sponsor’s first attempt, or if an entrant is found to be ineligible, an alternate winner may be drawn.

Prizes.  Ten winners and one guest per winner will win a Port Paradise Cruise trip.  The trip consists of round-trip coach air transportation from gateway city in the continental United States nearest winner’s residence (as determined by Sponsor in its sole discretion) to city of port (Port Canaveral, FL), transfers to/from ship and  Orlando, FL airport, standard double-occupancy outer ship accommodations for three (3) nights (unless winner chooses not to take a guest, in which case winner will have the entire cabin), all inclusive food (non-alcoholic and alcoholic beverages not included) and gratuities on board the ship and admission to a Dave Matthews Band concert on Port Paradise on the evening of October 25, 2009 for winner and one guest. Travel expected to occur between October 23, 2009 and October 26, 2009. Exact travel dates to be determined/communicated at a later date, by Sponsor, in Sponsor’s sole discretion. Travel/accommodations are subject to change and restrictions may apply. Sponsor is not responsible for any necessary ground transportation from the airport to the port or port to the airport or for hotel accommodations for winner and guest prior and/or after the Port Paradise Cruise.  Winner and guest must have valid passport or original birth certificate upon boarding the ship. Winner and guest must travel on the same itinerary, and comply with all security requirements. Any additional ground transportation, passport fees, trip cancellation insurance, personal purchases and all other expenses not specified herein are solely the winner’s responsibility. If winner cannot accept prize as specified, prize will be forfeited and awarded to an alternate winner. Approximate Retail Value $585.00 (for winner and one guest). Actual value depends on city, day, and time of departure. 

General Conditions. This Sweepstakes is void where and to the extent prohibited by law and is subject to all applicable laws, including, without limitation, federal, state, provincial and local laws and regulations. In the event of non-compliance by any winner with the official rules of this Sweepstakes or in the event the winner is ineligible for any reason, an alternate winner may be selected. Prizes are non-transferable. Return of any prize or prize notification as undeliverable will result in a disqualification of the winner and an alternate winner may be selected. All prizes will be awarded. Except where legally prohibited, acceptance of any prize constitutes permission for Sponsor to use each winner’s name, photograph, likeness, voice, address (city and state/province/territory) and testimonials, in printed, broadcast or other media, whether now known or hereafter developed, in perpetuity, in any manner it deems appropriate in connection with promoting this or any other Sweepstakes and/or promotion sponsored by it, without further compensation to the winner.

Releases. By participating, entrants agree that Sponsor, those involved in the development, production (including prize suppliers), implementation and distribution of this Sweepstakes and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion (hereinafter collectively called "Promoters"), shall not be liable for any claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Sweepstakes, including entry and participation in this Sweepstakes and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to such entrant’s participation in this Sweepstakes, such entrant will indemnify and hold Promoters harmless from and against any and all such claims, including reasonable attorneys’ fees related thereto. Promoters shall not be liable for entries that are delayed, lost, misdirected, misdelivered, incorrect or incomplete, and such entries will be not be eligible for this Sweepstakes. Promoters shall not be responsible for any technical malfunctions of any telephone network, computer on-line system, computer equipment or software; program malfunctions or other failures; delayed computer transactions or network connections; any errors of any kind, whether human, mechanical or electronic; or any combination thereof, including, without limitation, any injury or damage to the computer of any entrant or any other person related to or resulting from downloading any part of this Sweepstakes. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should viruses, bugs or other causes beyond its control corrupt the proper administration or security of the Sweepstakes. Sponsor reserves the right to modify the rules of the Sweepstakes in any way or at any time, as long as reasonable notice is given. All taxes on any prize won are the sole responsibility of each winner, including, without limitation, any federal, state, or local taxes which may be deemed applicable in such winner’s jurisdiction of residence. This Sweepstakes shall be governed by the laws of the Commonwealth of Virginia, United States of America. By participating in this contest, entrants agree that the state and federal courts located in the Commonwealth of Virginia shall have jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue for such litigation shall be only in the Circuit Court for the City of Richmond, Virginia or the United States District Court for the Eastern District of Virginia, Richmond Division.

To receive a copy of these Official Rules or the winner list, send a self-addressed stamped envelope to: Big Dave Matthews Band Cruise Giveaway Sweepstakes – Official Rules or Winners List, P. O. Box 1873 , Charlottesville, VA 22903. Specify "winners list" or "rules" on your request. WA, VT and Canadian residents may omit return postage.  The Sponsor of this Sweepstakes is Musictoday, LLC located at 5391 Three Notched Road, Crozet, Virginia 22932.

Certain Prizes.  For any prize awarded hereunder that involves a ticket, boarding pass, back stage pass, VIP pass, access to a venue, access to air, ground or water transportation, or access to an entertainer or entertainer group (collectively, a “ticket”), the ticket shall be a revocable license to the specific event, location for the location and time indicated to the prize winner by the Sponsor.  The Promoters reserve the right, without the award of any substitute prize or payment of any cash equivalent value, to refuse admission or to eject any person who fails to comply with the rules of the applicable event, airline, cruise line, or venue. No exchanges. The ticket user assumes all risks of personal injury incidental to the event or transportation, whether occurring prior to, during, or subsequent to the event, and holder voluntarily agrees that the Promoters, cruise line, airline, venue/facility, league or team, artist(s) performing, participants, participating clubs, and all of their respective agents, officers, directors, owners and employees are expressly released from any claims arising from such causes. The prize winner/user bears all risks of inclement weather. Tickets lost or stolen can not be replaced. Times and dates are subject to change. The resale or attempted resale of a ticket is prohibited and if discovered will result in the ticket being voided without the award of any substitute prize, exchange or payment of any cash equivalent value. The ticket may not be used for advertising, promotion (including contests and sweepstakes) or other trade purposes without the express written consent of the Promoters.
